Overview:

These EatStreet Cashback Rewards Program Terms and Conditions (?Program Terms?), in addition to EatStreet's Terms of Use, Privacy Policy, and Promotional Terms and Conditions apply to the EatStreet Cashback Rewards Program (?Program?). As used in these Program Terms, ?EatStreet,? ?Merchant,? ?Services,? and ?you? or ?your? are defined in EatStreet's Terms of Use.

By participating in the Program, you hereby acknowledge and agree to be bound by these Program Terms. EatStreet reserves the right to change these Program Terms at any time. Your continued participation in the Program and use of the Services after EatStreet has posted an updated version of the Program Terms constitutes your agreement to the updated version, and the updated version will be effective as of the time of posting or on such later date as may be specified in the updated version.

EatStreet Cashback Rewards Program: From time-to-time EatStreet may choose to offer the Program in which you accrue gratuitous credits (?EatStreet Cash?) on eligible orders that can be redeemed on future EatStreet orders.

Subject to eligibility requirements, no additional registration, enrollment, or information is required for participation in the Program. EatStreet Cash will accrue automatically on eligible purchases.

You must have a valid EatStreet account and a valid form of accepted payment on file in order to accrue and use EatStreet Cash. EatStreet Cash has no cash value and may not be withdrawn, auctioned, traded, copied, transferred, bartered, modified, sold, or redeemed for cash or a cash equivalent. Your use of and access to the Program and EatStreet Cash is subject to EatStreet's Terms of Use, Privacy Policy, and Promotional Terms and Conditions. EatStreet reserves the right at any time, with or without notice, to remove you from the Program or remove or adjust your EatStreet Cash if EatStreet suspects you have engaged in illegal or fraudulent activity or determines, in its sole discretion, that you have abused the Program or violated these Program Terms or any other applicable agreement between you and EatStreet.

Orders Adjustments: EatStreet Cash will not accrue for refunded orders, whether initiated by you or by a Merchant. Accordingly, your EatStreet Cash will be subject to adjustment at EatStreet?s sole discretion in connection with order cancellations, refunds, payment disputes, or errors.

Eligible Items; Restrictions: The Program is subject to EatStreet?s selection of how EatStreet Cash is accrued, earned and redeemed, which will be published and may be modified from time to time. EatStreet Cash cannot be earned on or redeemed on any restricted items, as determined by EatStreet in its sole discretion from time to time, which may include alcohol and other restricted items where prohibited by law. EatStreet reserves the right to update at any time which items are eligible to accrue EatStreet Cash for future purchases. Redemption: EatStreet Cash will be applied toward an order subtotal only (prior to the applicability of any fees). EatStreet Cash cannot be redeemed or applied retroactively for prior purchases or deliveries.

Expiration: EatStreet in its sole discretion may choose whether EatStreet Cash accrued for the Program either (i) expire after a specified period of time following their accrual; or (ii) never expire, which will be published and may be modified from time to time. Modification Termination EatStreet reserves the right to modify, suspend, terminate, or discontinue the Program, in whole or in part, at any time without any notice to you. In the event of termination or modification of the Program you will not be entitled to any substitute, credit, or compensation for unredeemed EatStreet Cash.

Miscellaneous In the event of any conflicts with these Program Terms and the Promotional Terms and Conditions, these Program Terms will control.
